PONTIAC, Mich. – A person who was not allowed to carry a firearm was arrested due to a prior conviction Oakland County when a weapon seen in his Instagram posts and rap videos was found at the scene of a car chase that ended in a crash.
Case background
Marcus Dewayne Clark Jr., 21, pleaded guilty in November 2020 to carrying a concealed weapon in Oakland County.
In December 2020, he was sentenced to trial under the Holmes Youthful Trainee Act, but on February 2, 2021, that status was revoked and he was charged with carrying a concealed weapon.
As a result, Clark was prohibited from possessing firearms.
Instagram and YouTube ads
On October 15, 2021, an agent with the Bureau of Alcohol, Tobacco, Firearms and Explosives reviewed an Instagram profile and determined Clark was the owner.
On August 14, 2021, the account posted several photos of the Century Arms Draco AK Pistol with the caption, “[e]It blew up when they said they saw us. The caption is a link to a YouTube video.
The location of the photos was listed as “Florida.”
Owners of the pistol said it had a distinctive wooden frame with black wear and tears. A 30-round “US Palm” magazine was loaded into the gun, according to a criminal complaint.
An ATF agent found a rap music video posted on YouTube that showed Clark wearing clothes and holding a gun similar to the Instagram photos, authorities said.
Michigan Secretary of State records showed that the people seen with Clark in the video lived primarily in Pontiac and Southfield. Two cars in the video have white and blue license plates, just like the ones from Michigan.
On September 1, 2021, the Instagram account posted more photos of Clark. He had what appeared to be one gun, officials said.
Another rap music video on YouTube showed Clark wearing the same outfit as the Sept. 1 Instagram post. He showed his face in the video and claimed to be shooting a Century Arms Draco AK, authorities said.
Clark’s connection to the Pontiac residence
Oakland County detectives reviewed YouTube videos and Instagram photos and determined that one of the videos was recorded at the Arbor View Apartments in Pontiac.
An ATF agent compared Clark’s position at the bottom of the stairs in one of the videos to the floor plan of the lobby, and it was a match, he said.
Police are following up on information about the shooting
On September 9, 2021, Oakland County deputies were called to the 180 block of Liberty Street in Pontiac for reports of a shooting.
A dispatcher told authorities the suspected shooter was heading north on Telegraph Road, and a short time later, a dispatcher saw a black Chrysler 200 heading north and its bright lights.
Police said the Chrysler passed the deputy, had its headlights off and sped away. The driver followed the Chrysler as it reached speeds of 70 mph in residential areas.
The vehicle crashed in the area of Orchard Lake Boulevard and Palmer Street. A man wearing a mask and wearing all black got out and ran, according to authorities. The witness chased him on foot, but lost sight of him.
Clark was sitting in the front seat of the Chrysler, according to the criminal complaint. He was arrested.
A Century Arms Draco 7.62 x 39 mm AK pistol was found on the ground near the driver’s side of the Chrysler, police said. One round in the chamber and 23 rounds in its 30-round “US Palm” magazine. He had black clothing and a tear on his arm, officials said.
Clark and a third man were arrested on suspicion of assault.
The price
Clark is accused of posting photos and videos of him holding a gun from August to September 2021, when he was not allowed to carry a gun.
The criminal prosecution concluded that Clark had a possible reason for possessing a firearm despite having been convicted of a felony punishable by more than a year, which affected interstate commerce.
