Supreme Court issued notice to builder Chintel India

The Supreme Court on Monday agreed to hear the plea of ​​residents of Gurugram’s Chintel Paradiso Society, part of which collapsed in February killing two women, seeking compensation and action against the developer. A bench of Justices KM Jospeh and Hrishikesh Roy issued notice to Chintel India Pvt Ltd and sought a reply to the petition filed by the residents.

“If you see your ad, it says a green and beautiful apartment. But it is not just beautiful in pictures. How can a recently built structure collapse like this? It is a very serious issue. We will issue notice,” the bench said.

Advocate Prashant Bhushan, appearing for the residential petitioners of Chintel Paradiso Society in Sector 109, Gurugram submitted that an audit of the structure revealed that the building was unsafe.

He said the residents have been asked to vacate all the towers so the builder has to pay the rent. Counsel appearing for the manufacturer told the court that an inspection is underway by the IIT and the expenses are being borne by it.

The bench will now consider the matter on January 6, 2023.

Earlier in February, two people died when the ceiling of several flats in a tower of the complex collapsed.

Following the partial collapse of Tower D, the Department of Town and Country Planning (DTCP) ordered a structural audit of the affected towers. A special investigation team headed by Additional Deputy Commissioner has also been formed to investigate the incident.

The authority, after conducting a structural audit, recommended the tower in question be demolished and the neighboring towers removed.
