Punjab and Haryana High Court shields Deepak Chaurasia from arrest in POCSO case, directs him to appear in court | Tech Reddy

The Punjab and Haryana High Court on Thursday stayed the arrest of news anchor Deepak Chaurasia in a case under the POCSO Act and directed him to appear in a Gurgaon trial court on or before November 17.

Justice Vivek Puri He said, Chaurasia will apply to the Gurgaon court to revoke the bail and arrest warrant.

“It is further directed that the arrest of the petitioner shall be stayed and the coercive measures ordered against the petitioner shall be stayed for 07 days till the disposal of the bail application against the petitioner. Dismissed,” said Justice Puri.

Chaurasia is facing trial in a 2015 case registered under Section 67B of the Information Technology Act, Sections 469, 471, 180, 120B of the IPC and Section 23 of the POCSO Act, 2012.

On October 28, the trial court canceled Chaurasia’s bail and ordered the issuance of an arrest warrant against him. He failed to appear in court that day. Although he filed an application seeking exemption from personal appearance on the grounds of health emergency, the trial court held that he had been “willfully avoiding his appearance” earlier.

Senior advocate Sumit Goel, representing Chaurasia, told the High Court on November 10 that Chaurasia could not appear before the trial court on the fixed date as he was admitted to Ashlok Hospital. He was admitted on October 28 and discharged on November 3, the court was told.

Accepting the submissions, Justice Puri said in the order, “Summary of waiver indicates that the petitioner was admitted to the hospital on 28.10.2022 i.e. the date of hearing before the learned trial court. Petitioner’s confinement in the hospital has resulted in unpleasant conditions. Appearance before the trial court”.

According to a Newslaundry report, Chaurasia was one of eight people charged for airing “edited”, “obscene” videos of a ten-year-old child and her family and linking the video to a sexual assault case against her. Styled Godman Asaram Bapu.
