Gurgaon woman to be given Rs 2 lakh compensation after dog attack

The District Consumer Disputes Redressal Forum on Tuesday directed the Municipal Corporation of Gurugram (MCG) to pay an interim compensation of Rs 2 lakh to a woman who was injured after she was attacked by a pet dog in August.

The forum also said that this compensation amount can be recovered from the owner of the dog if the MCG so desires.

On August 11, Vinit Chikara’s dog attacked Munni, who works as a domestic worker in the area, while she was on her way to work with her sister-in-law.

He sustained severe injuries on his head and face and was referred from Civil Hospital in Gurugram to Safdarjung Hospital in Delhi.

In the FIR registered at the Civil Lines police station, the dog’s breed is mentioned as ‘Pitbull’. Later the owner said that the breed is ‘Dogo Argentino’.

The forum directed the MCG to take custody of the dog and immediately cancel Chikara’s license to own the dog.

It ordered the ban of 11 foreign breeds and directed the MCG to pound all strays after taking them into custody.

The forum directed the MCG to frame a policy for pet dogs within three months.

“In the interest of justice, compensation of Rs 2 lakh has been ordered by the MCG as interim relief to the victim, who is said to be a very poor woman doing domestic work in another’s house.” Read the order.

“It is further clarified that the owner of the dog has clearly violated the law of the land and the rules made thereunder for keeping a prohibited breed of dog i.e. Dogo Argentino as a pet dog, hence MCG is given liberty to recover Rs. 2 lakh from the owner of the dog,” it said. has been

In the case, on behalf of the victim, lawyer Sandeep Saini filed a complaint in the consumer court under the Consumer Protection Act 2019 demanding compensation of Rs 20 lakh and impleading MCG and dog owner Neetu Chikara.

After hearing all the parties, the Sanjeev Jindal consumer court on Tuesday issued an order to completely ban 11 dangerous breeds of dogs in the district and to provide interim compensation to the victims.

“The following pet dogs of foreign breeds are completely banned with immediate effect from 15.11.2022 as per Government of India Notification dated 25.4.2016 namely American Pit-bull Terrier, Dogo Argentino, Rottweiler, Neapolitan Mastiff, Boerboel, Presa Canario, Wolf Dog, Bandog, American Bulldog, Fila Brasileiro and Cane Corso,” the court order said.

“The MCG is directed to cancel all licenses issued in this regard in favor of owners of dogs to keep the said breeds forthwith and to take the aforesaid dogs into its custody,” it said.
