Vijayawada: The Andhra Pradesh government on Thursday filed a recall petition in the Dharmabad court in Maharashtra in a case related to a protest by Chief Minister N. Chandrababu Naidu at the Babli project site in 2010.
The recall petition is scheduled to come up for hearing before the court on Friday and renowned Supreme Court lawyer Sandeep Luthra will appear on behalf of the Andhra Pradesh government.
This comes after Dharmabad Judicial First Class Magistrate NR Ghajbiye had rejected one of these recall petitions filed by the AP government on September 21 and insisted on Mr. Naidu’s personal appearance.
In a serious observation, the judge also remarked that the courts have no distinction between a Prime Minister and a common man and all are equal before the law.
The government had filed the recall petition after the Dharmabad judge had issued a non-bailable warrant (NBW) to Mr. Naidu and few others in the case related to the Babli protest.
After the recall petition was dismissed by the judge on September 21, the government’s lawyers sought time for Mr. Naidu’s personal appearance.
In response to the request, the Dharmabad court judge had posted the case to October 15. Meanwhile, another recall petition was filed on Thursday.
The case is related to a protest by Mr. Naidu against the construction of the Babli project in Maharashtra. Mr. Naidu led an agitation in July 2010 and wanted to visit the Babli project site, across the border, claiming that the project would affect those living in the valley in the North Telangana region of the then Andhra Pradesh. united
